3人涉為李全教賄選 遭判刑
（中央社記者楊思瑞台南31日電）台南市玉井區農會總幹事黃澄清等3人被控在去年議員選舉時為議長李全教買票，台南地院今天判決黃澄清5年徒刑，另兩人也都被判有罪。黃澄清說，會上訴。
台南市議長李全教在去年的3合1選舉中，於玉井區參選市議員當選。黃澄清等5人因涉嫌為李全教賄選，遭台南地檢署起訴，其中2名選民已在今年5月各被判處2個月有期徒刑，緩刑2年，褫奪公權1年。
台南地院今天下午針對黃澄清、望明里長李麗華、男子康清良等3人部分宣判。黃澄清處有期徒刑5年，褫奪公權4年；李麗華有期徒刑2年，褫奪公權2年，緩刑5年；康清良有期徒刑1年7月，褫奪公權2年，緩刑5年。
台南地方法院行政庭長郭貞秀表示，法官認定黃澄清等人藉發放工作費的名目，實際上是每票新台幣5000元代價走路工，忽視選民自發性、義務性認同候選人來造勢助選的性質，有賄選的對價關係。
郭貞秀表示，法官認定黃澄清是李全教競選總部總幹事，對資金運用是主導角色，因此罪責比較重。
黃澄清針對判決發表書面聲明指出，被台南地院以違反選罷法判刑不出意料；因本案自偵查至地院審理時，出現許多針對他故意違背刑事訴訟法之處。李全教則沒有對此判決發表意見。
黃澄清指出，對一審的不公判決當然會上訴，並就偵查至審理期間面對的許多不法，採取相關法律動作，以維個人清白暨司法純淨；也希望司法界與媒體界共同關心，相信不久必能真相大白。
台南市議會民進黨團發表聲明指出，黃澄清與李全教不論犯意聯結或是對價關係明確，可見李全教有賄選之實，希望李全教敢作敢當，不要視民主法治為無物。1040731
